The New Plan: On August 3, the Obama Administration announced its plan to control the production of electricity in the US in the name of protecting the planet from human-caused climate change, even though climate change has been occurring long before humanity existed. The administration’s plan is embodied in a 1560-page regulation released by the EPA titled the Final Rule, “Clean Power Plan” (CPP), to be published in the Federal Register sometime in the future. It is not until the rule is published in the Federal Register that activities such as litigation against it can begin, without the courts considering the litigation premature. The most important rules are on power plants operating today rather than those to be built or those which have to be modified or re-built.

The Final Rule contains major changes to the draft CPP including increasing the time given to the several states to comply with the rules by 2 years. Overall, the plan mandates that the states, together, reduce their emissions of carbon dioxide (CO2) by 32 percent below 2005 levels by 2030, a more stringent mandate than 30% in the earlier version. However, mandates to the states changed in what appears to be clear political bias, with states controlled by democrats seeing their mandates reduced while those controlled by republicans seeing their mandates increased.

A Physician’s Perspective on the EPA’s “Data Derangement Syndrome”

In the latest iteration of propaganda tactics employed by eco-environmental activists and the EPA, emotion has become the chosen media tool. Mothers and children pose on the capitol steps and wave signs proclaiming their fight for clean air and the children’s health. Images of these “lovable lobbyists” for the EPA’s Clean Power Plan are heart tugging. It is maternal instinct vs. scientific debate; if it sounds bad, that is all that such moms need to hear, and in fact, it is hard to overcome such pleadings with cold facts alone. Such “do something” demonstrations find politicians and agencies all-to-ready to craft new legislation and regulations. I view this much like physicians who succumb to patients’ “do something” demands by prescribing antibiotics for the common cold…a useless, if not dangerous practice.

Illegal EPA Scheming on Private Email Extended to GHG Rules

Former Secretary of State, and presumptive Democratic Party presidential nominee Hillary Clinton is not the only current or former Obama administration official facing investigation for use of a private email account skirting federal record keeping laws. The list of offenders recently grew longer, with an interesting twist.

In late May, House Science Committee chairman Rep. Lamar Smith (R-TX) wrote to the Environmental Protection Agency (EPA) and Department of Energy (DoE) seeking private-account emails of a former key staffer. He was following up on revelations from Freedom of Information Act (FOIA) requests I made on behalf of the Energy & Environment Legal Institute. Chairman Smith also wrote to the former appointee, a man named Michael Goo currently ensconced on Capitol Hill as a Democratic lawyer.

States Should Defy Unlawful EPA Carbon Dioxide Rules

Last June, the Environmental Protection Agency (EPA) proposed its Clean Power Plan as a nationwide regulation to reduce carbon dioxide (CO2) emissions from electrical power plants. Comments to the EPA have now been submitted, and it’s not a surprise that a majority of state governments oppose the plan. In the best interests of US citizens, states should refuse to comply with the proposed EPA Clean Power Plan.
